Frankston Vic Australia – Only in Australia.
A driver in the town of Frankston Victoria has successfully argued in a court of law that the the Ice Cream he ate caused a positive breath test this month. The unnamed man has an DUI Interlock switch on the ignition of his vehicle that requires a clear breath test to start the vehicle. The switch also records a positive attempt to start the vehicle whilst intoxicated.
The driver claimed he ate a popular ice cream bar, Bubble O Bill before attempting to drive and it caused the activation of the switch. In a dramatic courtroom demonstration, the accused tucked into another Bubble O Bill and again blew a postive result before the judges eyes. Before the test the device read 0.00% however after eating the ice cream and blowing, the device read 0.18%.
The switch was then granted to be removed from the mans vehicle. Experts added that some foods and drinks can cause a false reading on some designs of the ignition switches.
